Position Overview

ServiceMaster is seeking an experience labor & employment attorney to join the company’s Legal Department.  This position reports to the Vice President, Associate General Counsel and provide legal advice on a wide range of employment-law related matters.


Job Responsibilities

  • Provide advice and counsel to HR personnel and management on a wide range of employment-related matters, including the Fair Labor Standards Act, Title VII, ADA, FMLA, ADEA, Equal Pay Act, and similar federal, state and local employment laws and regulations.
  • Represent the company in pre-litigation employment disputes, including responding to attorney letters, discrimination charges filed with the EEOC and state regulatory agencies, administrative wage claims and attending mediations.
  • Draft and review employment-related documents, including personnel policies, compensation agreements, settlement agreements, job offers and severance agreements.
  • Conduct employment-related due diligence in connection with mergers, acquisitions and other business transactions\
  • Conduct and manage investigations regarding employee misconduct and ethical violations
  • Manage outside counsel in defending employment-related litigation and arbitrations
  • Develop and conduct training on employment-law related matters
  • Build and maintain positive relationships with HR, management and other business partners

Job Requirements

  • Juris Doctorate degree from an accredited U.S. law school and member of TN bar or ability to promptly become licensed in TN
  • 5 or more years of legal experience with deep substantive knowledge of federal and state employment laws, including litigating and mediating employment-related matters
  • In-house experience preferred but not required
  • Knowledge of California employment law, including wage and hour laws, strongly preferred
  • Excellent oral and written communication skills
  • Strong analytical and negotiation skills
  • Strong customer service orientation and commitment to responsiveness
  • Ability to work in fast paced environment and handle multiple tasks simultaneously
  • Demonstrated ability to take initiative and work effectively with minimal supervision
  • Outstanding judgment with focus on providing practical, business-oriented legal advice
  • Demonstrated ability to work effectively as a member of a team, including interacting effectively with other members of the legal department, HR, management and other business partners.
  • Ability to persuade, influence and build credibility with internal business partners
  • Proficient with computers and comfortable learning to work with multiple software programs and databases

  • Move up to 10 pounds occasionally, by lifting, carrying, pushing, pulling, or otherwise repositioning objects.

  • Fingering and Repetitive motions; such as movement of wrists, hands and fingers while picking, pinching and typing during your normal working environment.
  • Express or exchange ideas with others through the use of spoken word, quickly, accurately, and at an easily audible volume, and receive detailed information through oral communication at usual speaking levels without correction, and/or make fine discriminations in the nature of sounds in the environment.


Incumbent is required to have:

  • Close visual acuity to perform detail oriented activities at distances close to the eyes, as well as visual acuity to perform activities at or within arm’s reach with skill, control, and accuracy, such as preparing and analyzing data, viewing computer screen and expansive reading.

Incumbent will be subject to:

  • Inside working conditions: The change of building environment such as with or without air conditioning and heating.
